Work accidents are a critical concern in occupational health and safety, often leaving workers or their families grappling with physical, emotional, and financial burdens. Defined under Turkey’s Law No. 6331 on Occupational Health and Safety, a work accident refers to any event occurring at the workplace or during work-related activities that harms the physical or mental health of employees or, in severe cases, results in death. Understanding the compensation rights associated with these incidents is essential for employees and their families seeking justice and recovery.

Compensation Rights Following a Work Accident

After a work accident, Turkish Labor Law provides several types of compensation that injured workers or their families can claim. These include:

1. Moral Compensation

This form of compensation addresses the emotional and psychological suffering experienced by the worker due to the accident. If the worker has passed away, the worker’s immediate relatives are entitled to claim moral compensation.

2. Material Compensation

Material compensation aims to cover the economic losses incurred as a result of the accident. This includes medical expenses, loss of earnings, and other financial damages.

3. Compensation for Deprivation of Support

In the unfortunate event of a fatal work accident, this compensation is granted to the dependents of the deceased worker, ensuring their financial stability in the absence of the worker’s support.

4. Loss of Work Capacity Compensation

If the accident reduces the worker’s ability to perform their job, they can claim compensation for the diminished capacity to work, ensuring they receive financial relief for their reduced earning potential.

Statute of Limitations For Work Accident Claims

Under Article 146 of the Turkish Code of Obligations, claims related to work accidents are subject to a general limitation period of 10 years. This applies to all compensation-related lawsuits stemming from work accidents, as no specific limitation regulation exists for such cases. It is crucial to initiate legal proceedings within this timeframe to avoid losing the right to compensation.

Legal Process in Occupational Accidents

Navigating the legal process correctly is key to securing compensation after a work accident. Here are the essential steps involved:

1. Social Security Institution (SSI) Notification

Employers must promptly report work accidents to the Social Security Institution (SSI). The SSI evaluates the incident, prepares a report, determines whether it qualifies as a work accident, and assigns fault percentages to the involved parties.

2. Filing a Compensation Case

If the SSI classifies the incident as a work accident, the injured worker or beneficiaries can file a compensation lawsuit to claim both material and moral damages.

3. Work Accident Determination Case

If the SSI does not acknowledge the incident as a work accident, the affected party must file a case to have the accident officially recognized. This lawsuit involves both the SSI and the employer. Compensation lawsuits can only proceed after a final decision on this determination case.

Key Considerations in Work Accident Cases

Success in work accident cases often hinges on proper preparation and attention to detail. Consider the following:

1. Gathering Evidence

Critical documents such as witness statements, medical reports, and incident records should be meticulously collected and submitted with the case file.

2. Adherence to the Statute of Limitations

Legal actions must commence within 10 years from the date of the accident. Timely filing ensures the claim remains valid.

3. Petition Content

The legal petition must be clear, concise, and supported by relevant legal grounds to strengthen the case.

Authorized and Competent Courts

Work accident cases in Turkey fall under the jurisdiction of Labour Courts. Depending on the circumstances, cases can be filed in the court where:

  • The accident occurred,
  • The defendant resides, or
  • The workplace responsible for the accident is located.

Choosing the appropriate court ensures a smoother and more efficient legal process.
